Capital City Trail Storm Sewer Replacement, Thursday, February 20: A public information meeting is scheduled for 6 p.m., February 20, 2025, via Zoom. Registration prior is required.

Finance Committee: The Finance Committee meeting will take place on Monday, February 17, at 4:30 p.m. in virtual format. Agenda items include an overview of the 2026 budget calendar and process.
14. 87158 Authorizing amendments to the term sheet authorized by Legistar File No. 86170 regarding a Tax Incremental Finance Loan to EC Residential LLC, or its assigns, and a grant to the CDA related to the construction of affordable housing at 5546 Element Way in the University Research Park and Tax Incremental District (TID) 46 (District 19).
Fiscal Note The proposed resolution authorizes amendments to the term sheet related to the agreements between the City, the Community Development Authority (CDA), and EC Residential LLC for the development project at 5546 Element Way in TID 46. The amendments to the term sheet do not change the amount or type of TID 46-supported funding originally approved for the project via legislative file 86170 (RES-24-00730): $930,000 TIF loan to EC Residential LLC and $4,365,000 grant to CDA. No additional City appropriation required.
The grant to the CDA from TID 46 helps this affordable housing project meet the plans and objectives set forth in City of Madison TIF Policy. It keeps the City’s TIF loan under 55% of the Net Present Value of the increment generated by the project. Requests to exceed the 55% threshold require approval from the Finance Committee. Affordable housing projects do not generate as much tax increment making it harder for the developer to use TIF to cover the gap given the thresholds in the 2014 policy document. The Finance Committee will be working with Economic Development staff to review our TIF to be more flexible to aid affordable housing projects. The developer must enter into an agreement with the CDA for a loan and a grant. See Exhibit B for more info.
15. 87067 Authorizing the City of Madison to apply to the Wisconsin Department of Natural Resources for a Ready for Reuse Brownfields Cleanup zero-interest loan in an amount not to exceed $329,000 for the purpose of assisting in the remediation of contaminated soil at Huxley Yards (2007 Roth Street). (District 12)
Fiscal Note The proposed resolution authorizes the City of Madison to apply to the Wisconsin Department of Natural Resources (WDNR) for a Ready for Reuse Brownfields Cleanup zero-interest loan for the purpose of assisting in the remediation of contaminated soil around the Conway at the Huxley Yards property.
A separate resolution will be required to authorize acceptance of the loan, to amend the Economic Development Division’s adopted budget to reflect the loan, and to approve the terms and conditions of a loan agreement between the City and the WDNR as well as to approve the terms and conditions of a loan agreement between the City and Lincoln Avenue Capital Management, LLC.
16. 86954 Authorizing the Mayor and City Clerk to execute a non-competitive Purchase of Services Contract with The Welch Group for government affairs and strategic advocacy services for one year with the option of two one-year renewals.
18. 86986 Amending the 2025 Economic Development Division Capital Budget for TID #44 by $500,000 to fund small business development programs, amending the 2025 Economic Development Division Capital Budget for TID #46 by $750,000 to fund small business development programs, amending the 2025 Economic Development Division Capital Budget for TID #51 by $850,000 to fund small business development programs, and amending the 2025 Economic Development Division Capital Budget to transfer $1,170,000 from the TID 51 capital program (program #99011) to the Land Banking program (program #12640) to fund demolitions of Land Banked properties at 1810 S. Park Street, 1901 S. Park Street, 814 North Avenue, and 826 North Avenue (District 3, District 9, District 11, District 14, District 15, District 19).

12. 86649 Repealing and recreating Section 28.185 and creating Section 41.28 of the Madison General Ordinances related to demolition of buildings to update the approval processes.
Public testimony last week at Landmarks Commission raised concerns about changes to the statement of purpose and standards of approval in 28.185 for Plan Commission review of demolitions, and the process for Landmarks Commission in 41.28 to assign categories for historic significance. The Mayor and alder sponsors have introduced a substitute to address some of the concerns that were raised. Staff Report addendum explain the changes.
Landmarks Commission voted to accept the language in 41.28 that codifies in a new Subchapter 41.28H, the process to review demolitions based on categories of historic significance that were previously in their policy manual. The new ordinance adds language to allow administrative approval of Category C buildings that have no known historic value after LC has reviewed them. If this is adopted, buildings with no known historic value would no longer need to go to Plan Commission. Commissioners also recommended changes to the ordinance language to clarify that buildings on archeological sites may have Category C buildings. Finally, Landmarks asked for the changes in 28.185 to be referred back to them because they were not able to make recommendations.
In my view, the statement of purpose has been improved but the standards of approval are unchanged and significantly altered from the existing ordinance. The way I interpret the proposed new “factors” that can outweigh the public interest in preservation is that only one factor needs to be found to be met to approve demolition of buildings with historic value. The existing ordinance is included in the text of 86649 so you can compare the changes. I am working on drafting an alternate/amendments to address my outstanding concerns.
