Statement by City Attorney Michael P. May on the DiPiazza Trial

I am extremely disappointed in the federal jury verdict that found the Madison Police Officers liable for excessive force, and awarding damages. All of our analysis, both by our internal and outside experts, concluded that the officers acted within the legal standards for use of force. The jury found otherwise.
The officers were represented by outside legal counsel through the City’s insurance carrier, Wisconsin Municipal Mutual Insurance Company (WMMIC). The damages in this case are covered under the City’s insurance policy. The City will be meeting with our legal counsel and WMMIC to determine our next steps, including whether there are grounds for an appeal.
In the meantime, I have directed the Mayor, Alderpersons and other City officials and employees to refrain from public comment on the ongoing case. I will not have any further comment until we meet with our attorneys in the case.
