D6 Items of Interest Week of July 1, 2024

This week is shortened by the July 4th holiday. I hope you have an enjoyable and safe holiday. There are several referrals on Tuesday’s Council agenda including the proposal to place geographic limits on Class A licenses (carry out), the Native Tall Grass Lawn Areas registration, Large Item Collection and Sales Tax. More details below. For introduction and referral is an appeal of the Plan Commission’s 6/10/24 approval of the conditional use permit for 6610-6707 Old Sauk Rd. At the last Council meeting, we approved the rezoning and Certified Survey Map and heard a lot of public testimony. The nearby neighbors met the threshold to appeal the Plan Commission’s decision and the Council will hear the appeal on July 16. The appellants are focusing on inadequate, and “novel and theoretical” storm water solutions per their appeal letter (copied below). 

Boards, Commissions, and Committee Meetings

City committee meeting highlights, announcements, and events are prepared by Council staff with additional details added by me for this merged D6 Items of Interest and City Highlights blog post. 

  • Landmarks Commission will review a proposal to divide the land surrounding the landmarked Wiedenbeck-Dobelin Warehouse - 619 W Mifflin building and add a new adjacent building 

  • City County Homeless Issues Committee Staff will review the city and county budget process and then there will be a public listening session about the budget process CCHIC Agenda 07.01.24

  • Common Council: The Common Council meeting will take place on Tuesday, July 2, in virtual format at 6:30 p.m. Agenda items include creating registration and enforcement systems for Native Tall Grass Lawn Areas and refining other lawn maintenance provisions within the Section, adopting the 2025 Common Council meeting dates, and approving the Large Item Collection and Electronic Waste Recycling policy. 

The Native Tall Grass Lawn Area 83601 and the Large Item Collection ordinance amendments 83632 and Large Item Collection policy update 83634 are recommended to be re-referred so they can be discussed at other boards commissions and committees before they come back to the Council on 7/16/24.

25. 77906 Change of Licensed Premises 2116 AWA LLC • dba The Atwood Current Capacity (in/out): 160/0 • Proposed Capacity (in/out): 160/20 2116 Atwood Ave • Agent: Brian Mason Class B Combination Liquor & Beer • 85% alcohol, 10% food, 5% other Alder District 6 (Alder Rummel) • Police Sector 410 Request to extend premises outdoors to rear patio for four 10' x 10' tents, at time a perimeter fence will be present with signage reading "No Alcohol Beyond This Point.". 

At their meeting of 6/26/24, the ALRC voted to RECOMMEND TO COUNCIL TO PLACE ON FILE WITHOUT PREJUDICE. The applicant has not acted on their 2023 application.

26. 83316 21+ Entertainment License Umami Dumpling & Ramen Bar LLC • dba Umami Ramen & Dumpling Bar Capacity (in/out): 50 923 Williamson St. • Agent: Janmin Michael Ding Class B Combination Liquor & Beer • 20% alcohol, 80% food Police Sector 408 (District 6)

At their meeting of 6/26/24, the ALRC voted to RECOMMEND TO COUNCIL TO PLACE ON FILE WITHOUT PREJUDICE. The applicant decided to withdraw the 21+ license app after talking to MNA Preservation & Development Committee and nearby neighbors.

28. 83669 Amending Section 38.05(9)(a) and creating 38.05(b) and (c) of the Madison General Ordinances related to Class A and Class “A” alcohol beverage licenses to impose geographic limitations on “Class A” and Class “A” license applications considered by the Common Council after adoption of this ordinance for purposes of regulating density of such alcohol beverage licenses.

Due to a very long agenda at their meeting of 6/26/24, the ALRC voted to re-refer to the Alcohol License Review Committee (7/17/24), Common Council (8/6/24). Check out the comments in the link for the public health and business impacts of this proposal.

In addition, there are several other D6 alcohol related items recommended for adoption: #12 Grey Market new license, #52 The Moxy change of licensed premises, and four Temporary Class B licenses for neighborhood festivals (Orton Park, Schenks Corners Block Party, Willy St Fair, and the Fete de Marquette).

78. 83601 Amending Section 27.05 of the Madison General Ordinances to create registration and enforcement systems for Native Tall Grass Lawn Areas and refine other lawn maintenance provisions within the Section. Sponsors: Yannette Figueroa Cole

This item is being referred Sustainable Madison Committee (7/22/24) and Council (8/6/24). In addition, the Madison Chapter of Wild Ones sent all alders a letter in opposition to the scope of the proposed changes and made very thoughtful recommendations, their letter should be in legistar by next week. (For those of you who knew/remember Tim Wong, he would be on this...)

79. 83632 Amending Section 10.18 and 1.08(3)(a),and creating Section 27.05(2)(dd) of the Madison General Ordinances to update the City’s large item collection and electronic waste recycling ordinances, and to update the bond schedule accordingly. Sponsors: Satya V. Rhodes-Conway, Derek Field And Sabrina V. Madison

80. 83634 Approving the Large Item Collection and Electronic Waste Recycling Policy.

#79 & #80 are being re-referred to Finance (7/8/24), Board of Public Works (7/10/24) and Common Council (7/16/24).

87. 83518 Requesting information, studies, and plans regarding the authorization of a local sales tax. Sponsors: Amani Latimer Burris

The recommendation is to re-refer to Common Council (7/16/24) at the request of the lead sponsor and Council President. There is a lot going on in this resolution. Finance and CCEC voted to place on file. One of the stickies is the following section that establishes guidance for the 2025 budget

“Recognizing that it’s unlikely that there will be a special session of the Legislature to take up a Madison sales tax this summer but there is certainly the ability to take this matter up in 2025, we ask that this Committee work with the Finance Department to:

6.                     Devise a temporary solution for 2025 that as necessary:

a.                     Provides money for the 2024 budget,

b.                     Uses one-time sources, revenues and/or rainy-day funds, given the significant returns on city investments in 2023 and anticipated for 2024,

c.                     Considers closing TIFs and,

d.                     Avoids going to a property tax referendum or massive layoffs (that could happen if such a measure fails).”

The City Attorney’s office prepared a Staff Memo on Regional Transportation Authority for the Transportation Commission per the sponsor’s request. An RTA, which would require changing state law to allow a regional sales tax to fund transportation, would be a gamechanger and a way to fund BRT and accessible regional bus service. Hopefully every Dane County area candidate for State Senate and State Assembly will be on board to work on this.

92. 83678 Awarding Public Works Contract No. 9358, Bartillon Shelter (District 12) and amending the 2024 Adopted Capital and Operating Budgets of the Community Development Division to provide funding needed to complete the project. (District 12) Sponsors: Satya V. Rhodes-Conway, Yannette Figueroa Cole, Amani Latimer Burris, Tag Evers And Marsha A. Rummel

Fiscal Note: The proposed resolution authorizes the award of Public Works Contract No. 9358, Bartillon Shelter and amends the 2024 Adopted Capital and Operating Budgets of the Community Development Division. The budget amendment transfers $2,000,000 of existing American Rescue Plan Act (ARPA) funding from the youth-focused affordable housing development project at 1202 S. Park Street (Munis 13776) to the Bartillon Shelter project (Munis 13346). In its place, the resolution authorizes up to $2,000,000 of Federal Emergency Rental Assistance Housing funds, that are available in the 2024 CDD Adopted Operating Budget, and currently uncommitted, to support the 1202 S. Park Street development.

114. 82973 Repealing and Recreating Section 33.24 of the Madison General Ordinances related to the Urban Design Commission to implement Phase 1 of planned multi-phase revisions to the UDC ordinance. Sponsors: Marsha A. Rummel

The recommendation is to re-refer to Plan Commission (7/29/24), Urban Design Commission (7/17/24), Common Council (8/6/24). At the UDC meeting last week, UDC members discussed the staff report and reviewed the potential changes (Attachment B) proposed by some of my alder colleagues. 129. 84168 Authorizing the Planning Division to continue the Artist at Work program, focusing on destination marketing for Madison’s music sector, and to select and contract non-profit partners as grantees. Sponsors: Marsha A. Rummel

Fiscal Note: The proposed resolution authorizes the Planning Division Director to execute agreements and expenses for the 2024 Artist at Work program in the total amount of $75,000. The 2024 Adopted Room Tax Fund Budget included a $75,000 allocation for the Artist at Work program. No additional City appropriation required. “The Planning Division is authorized to contract with Destination Madison Foundation, Inc. for $15,000, Make Music Madison, Inc. for $15,000, Overture Center Foundation, Inc. for $15,000, and Urban Community Arts Network, LTD for $20,000 to support positions that promote Madison as a music destination, and use $10,000 towards testing branding, marketing, and community engagement for Madison’s music sector”

131. 84175 Authorizing the Transportation Department, to submit a grant application to the Wisconsin Department of Transportation for up to $500,000 dollars, accept grant funding if awarded, and authorizing the Mayor and Clerk to sign the resulting grant agreement. Fiscal Note: The proposed resolution authorizes the application and acceptance of a WI DOT Carbon Reduction Program grant to support the development of a Curb Management Action Plan. The requested grant amount is up to $500,000 with a local match up to $100,000. Funding for the local match will be included in the Parking Division’s 2025 operating budget request and supported by Parking revenues.
